EdistoBeach.com is an independent visitor guide to Edisto Beach and Edisto Island, South Carolina, owned and operated by Conceptrix, LLC (“we,” “us” or “our”). These Terms of Service (“Terms”) apply to your use of https://edistobeach.com (the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. About the Site
The Site offers free travel information about Edisto: places to stay, restaurants, things to do, events, beach access, tides and weather. We are not affiliated with the Town of Edisto Beach, Edisto Beach State Park, Colleton or Charleston County, or any government agency, and nothing on the Site is an official notice.
Information Can Change
We work to keep the Site accurate, but business hours, menus, prices, event dates, rules and conditions change, often without notice to us. Tide and weather information comes from outside sources and is provided for general planning only. Always confirm details directly with the business, event organizer or official source before you go, and do not rely on the Site for safety, navigation, boating, fishing or swimming decisions. Follow posted beach rules, flags and instructions from lifeguards and officials.
Bookings, Affiliate Links and Other Websites
The Site links to other websites, including vacation rental, hotel, restaurant and tour companies such as Vrbo. Some of these are affiliate links, which means we may earn a commission if you make a booking, at no extra cost to you. We do not take reservations, collect payments or charge booking fees. When you book or buy through another website, your agreement is with that company, under its own terms, prices, cancellation rules and privacy policy. We do not control and are not responsible for other websites, their content, or the products and services they provide.
Business listings, mentions and ads on the Site are not endorsements or guarantees of any business’s quality, safety, licensing or availability.
Content You Send Us
You may be able to leave comments, send messages through our contact form, sign up for our newsletter or submit a business or event listing. You must be at least 18 years old, or have a parent or guardian’s permission, to do so. You are responsible for what you post or send, and you confirm that it is accurate and that you have the right to share it. By posting or submitting content to a public area of the Site, you give us a non-exclusive, royalty-free, worldwide and perpetual license to use, edit, display and distribute it on the Site and in materials that promote the Site. We may review, edit, decline or remove any content at any time, for any reason.
Acceptable Use
When you use the Site, you agree not to:
- post anything unlawful, false, misleading, defamatory, harassing, hateful, obscene or threatening;
- post spam, chain letters or advertising, or solicit other visitors, without our written permission;
- post material that infringes someone else’s copyright, trademark, privacy or other rights;
- collect personal information about other visitors, or use information from the Site to contact, harass or harm anyone;
- upload viruses or harmful code, try to gain unauthorized access to the Site or its systems, or interfere with how the Site works; or
- copy or scrape the Site’s content in bulk, by automated means or otherwise, except as allowed by standard search engine indexing.
We may suspend or block access to the Site, or remove content, for anyone who breaks these Terms.
Our Content
The Site’s text, photos, maps, graphics and design are owned by Conceptrix, LLC or used with permission, and are protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use, and you are welcome to link to the Site. You may not otherwise copy, republish, sell or distribute our content without our written permission. EdistoBeach.com is a trademark of Conceptrix, LLC.
Copyright Complaints
If you believe something on the Site infringes your copyright, email support@conceptrix.com with: your name and contact details; a description of the work you believe was copied; the address (URL) of the page where it appears; a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature. We will review the notice and remove the material where appropriate.
Disclaimer
The Site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, error-free or free of harmful components. Your use of the Site, and any trip, booking or activity you plan using it, is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Conceptrix, LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or enjoyment, arising from your use of the Site, any content on it, or any business, website or person you find through it, even if we were told such damages were possible. Our total liability for any claim relating to the Site is limited to the amount, if any, you paid us to use it. Some places do not allow these limits, so they may not all apply to you.
Indemnity
You agree to defend and hold harmless Conceptrix, LLC and its owners, employees and partners from any claims, losses and costs, including reasonable attorneys’ fees, that arise from content you submit, your misuse of the Site or your breach of these Terms.
Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in the State of Tennessee, and you consent to the jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. By continuing to use the Site after a change, you accept the updated Terms. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
